And the scam continues Unabated.

SCANDALS  ---  PART 10

AND THE SCAM CONTINUES UNABATED.....THE BIGGEST SCANDAL OF ALL TIME IN CENTURY VILLAGE.

Scam?  What scam?  The WPRF/Benenson Capital scam, that scam.  Why is it a scam,? ---- because the people
of Century Village have literally been cheated out of their money, -- just like the pea and the walnut shell game,
that's how.

Can you be more specific?  Of course.  ALL MAINTENANCE AND REPAIR WORK ACCORDING TO THE MILLENNIUM
AGREEMENT AND AMENDMENTS THERETO, ARE THE FULL RESPONSIBILITY OF UCO, WHO REPRESENTS 309
CORPORATIONS, OR 7,854 UNIT OWNERS, I.E., THEY MAKE FULL PAYMENT FOR SAME UNDER THE HEADING
OPERATING EXPENSES.  OKAY, ALL CAPITAL IMPROVEMENT WORK ACCORDING TO THE MILLENNIUM AGREEMENT AND AMENDMENTS THERETO, ARE THE FULL RESPONSIBILITY OF THE MANAGEMENT COMPANY,  OR WPRF/BENENSON CAPITAL, I.E., THEY MAKE FULL PAYMENT FOR SAME.  THOSE ARE THE ABSOLUTE FACTS.

Is there an argument there?  Yes.  There always has been, but nobody dares to bring it up; that is not only sheepish and
cowardly but extremely costly to Unit Owners,  --- like
e x t r e m e l y.  The Management Company dictates to UCO that everything was done, whether interior or exterior, to the Clubhouse and adjoining property, are Maintenance and repairs and considered Operating Expenses, whether it's changing a door lock worth $50. or replacing an entire air-conditioning system worth $800,000.

Of all the years the Millennium Agreement has been in existence, never has the difference of opinion as to whether an item of work is Maintenance and Repair or as a legally defined Capital Improvement been taken to Arbitration.  The Millennium agreement provides for Dispute Resolution (Arbitration), 4 pages, so why are the people of CV so afraid to move on it....there is nothing to lose and everything to gain.  Millions of dollars have already been lost by sitting back and doing nothing. But, everybody says that it's up to the President; no it isn't!  It's up to the people, in fact, it's up to the Board of Directors, commonly known as the Delegates, to instruct the President.

Look at the records for the past 16 plus years.  There has never been a matter brought to Arbitration because of a dispute as to who pays for CV work.  We are talking about millions of dollars, and because the Management Company plays the Millennium Agreement interpreter, the Judge and the jury, -- and under threat of shutting down everything if they don't get their way, ---that is the SCAM and more appropriately, -- the SCANDAL.

One previous UCO President let it all happen with nobody caring about what he was doing.  One other UCO President was receiving monies on the side that amounted to thousands of dollars and then merely faded away.  Even another UCO President conjured up his own secret side deals and caved in to Management, and eventually he had to get out of the Village or face legal consequences. And now the present UCO President, with all the pertinent records in hand must have something going or he would have immediately stepped up and acted, and did what a President should do for all of the Unit Owners.......fight for what is right and known to be true.  Ask ---- what private deal has he got going?  Any reasonably thinking person would be compelled to ask that question.

Just stop and think.... THINK!!!   What right does a WPRF attorney have to state in writing that the intended new air-conditioning system is not a Capital Improvement; that it's Maintenance and Repair, or what the attorney wants to call an Operating Expense.  To put that in writing reveals that she knows absolutely nothing about architecture and engineering, and recognized standards.  And, the UCO President says nothing and does nothing.  Is this a joke.....is this a $800,000. joke?  So, somebody, like a Committee Member, who really doesn't know anything about anything, says, --- "Well, it's always been that way, so why change it now?"  This is the mentality we have today, and when the costs to every Unit Owner goes so high, history reveals that they just get up, deny everything, and leave rather than fight for truth and justice.

THE SCANDAL OF CENTURY VILLAGE OF WEST PALM BEACH.  This happens right before your very eyes, and the leader,
the UCO President, looks the other way and does nothing.  He dictates to the zombie-like, hypnotized Delegates.  This is a story for "60 MINUTES."

A SCAM  is a SCAM is a SCAM.  Give this entire matter to a first year law student and we, the people of CV, will win........

  1. Why on earth don't people rise up and throw the president or the entire government out of their positions? The people need an aggressive lawyer that can shake things up and get to the bottom of this scandal. Form a committee to fight corruption. It looks like this Century Village badly needs such a committee.

  2. Very, very interesting article, and it looks like a real bombshell. You state that the Millennium Agreement requires WPRF/Benenson Capital to pay for all Capital Improvements. I looked it up and you are correct about that. My question is, why doesn't somebody ask WPRF what their interpretation is of a Capital Improvement, and then give their answer to an attorney. In other words, shake their sacred tree and see what can be arbitrated. The biggest question, of course, is why isn't the UCO President doing anything about it.

    I think people believe this is a situation involving the so-called Malcontents and UCO because President Israel has ordered them to believe it. Of course it's not. It is a matter involving the Management (UCO/Benenson Capital) and Century Village of West Palm Beach (7,854 Unit Owners). What a scandal!!

    1. It is UCO'S responsibility to represent the residents in matters of dispute. David Israel and his administration do not do this. That is the main reason they must be voted out of office. As long as they stay in power, we will forever be paying higher and higher dues.

  3. Read the CV Messenger newspaper. You will see that the Messenger club sought legal advice on this issue. An unbiased opinion from a law firm stated in no uncertain terms and sent a letter to David israel telling him that it is wrong to force residents to pay for the a/c repairs. UCO countered by getting their lawyer to write a letter stating an opposite opinion. the Messenger club says that due to the opposing opinions. the matter should be settled in the dispute resolution procedure written into the lease agreement. So far David Israel has refused to consider this option.Kudos to Ed Ross for standing up for us, and brickbats to David Israel for standing against us. We can look forward to more of the same unless a recall is done. and done soon.

    1. This is the most ridiculous thing I've ever heard. In this entire matter of WPRF/Benenson Capital paying for Capital Improvements, --- it is fact that UCO, UCO's Attorneys, David Israel, the Messenger Club and it's newspaper, and all of Century Village's 7,854 Unit Owners A R E A L L O N T H E S A M E S I D E. I don't understand why people don't get that, or don't want to. Maybe one of the major players is a crook and is defending the powerful WPRF/Benenson Capital organizations.

      We should get one thing straight, -- UCO's lawyer is, in fact, the lawyer representing the Unit Owners because UCO IS Century Village of West Palm Beach. The lawyer is no doubt being paid with OUR money and is coming out of the single bank account (instead of the 7 individual accounts set up by Dorothy Tetro to account for all of the monies), where Israel can hide how the money is spent. Again, the lawyer acting for UCO is being paid using OUR money, and therefore, that lawyer works for us (7,854 Unit Owners), not for Israel.

      The Delegates, or Board of Directors, can instruct Israel to fire the lawyer who makes statements, written or oral, that are not in the best interests of the CV Unit Owners. Israel has no right whatsoever to instruct this lawyer to act in a certain way without first obtaining the approval of the Board of Directors (Delegates). He needs an approval of the Delegates for all costs exceeding $1,000.

      Israel has acted with indifference toward the people of CV and with reckless abandon, and he should be taken before a judge because he has violated rules and regulations and he may have even broken a law or two.

      This utter nonsense has got to stop....IT HAS GOT TO STOP! Why people do nothing about a "WRONG" that needs to be corrected, is way beyond my comprehension.

Everyone including the lawyers being on the same side may be true in theory, but not in practice, the lawyers, David Israel and the rest of the executives who consistently side with the owners with every issue are in fact not representing the residents interests, how does that put us all on the same side?.
