So what does this Book of Daniel's writing on the wall have to do with Century Village? Judging by the standing room only crowd at the Clubhouse yesterday for the meeting with a lawyer re the paving job, someone's days are numbered; his deeds have been weighed and he has been found wanting.
Who is this? Yesterday, the lawyer stated that in his opinion there was a good case against UCO and David Israel re the lousy paving job. He feels that be it he or another firm, there is a case to be made and said that evidently the lawyers on the opposing side felt the same way as they asked for a 30 day extension for handing over of requested files and papers.
Finally stating that yes, there were SOME mistakes made, and not acknowledging how many and how severe and the fact that the buck stops on his desk, David Israel has done too little too late. The roads in the Village are garbage, collapsing under our feet, flooding with every rain and getting worse by the day. The money is gone, wasted and we have no more.
There were some hostile people in the crowds, including one Canadian woman who was quite vocal in stating that if her complex in Canada can have cracks and flooding, then so can Century Village. Not sure about that logic or reasoning! Others, like Barbara Cornish, who needs to come out in the open already and admit she is an Israel groupie, said we are suing ourselves. No, we are not.
When you use your medical coverage, or file for a claim on your house or auto, are you suing yourself? NO!!!!!! We are suing the named parties, UCO and DAVID ISRAEL, and these entities have insurance for which we pay the premium and that is as it should be as they are supposed to be working for us. When they betray that trust then they open themselves to a suit. If anything, the premium might go up a bit, but not to an extent that will break us. What will break us is the amount we are going to have to fork up for the early repaving.
The lawyer recommended that associations as well as individuals join in the suit, thereby sharing in the results and allowing the suit to proceed. Why David Israel is making such a big stink over $20,000 is puzzling as almost that amount was approved for a new system of cameras and checking in to the Village, new signs for the entry to the Village, new flowers, etc, are approved routinely and they cost a whole lot more than $20,000, and the repaving will be a hell of a lot more than that. Shared by many, that sum is not terribly large. And it is voluntary. The money we will be forced to come up with or repay on a loan for the repaving is not voluntary.
So what about the roads and the repaving money? There is a good chance, that, as in many civil suits, there are negotiated settlements and part of that might be a fixed sum and/or requirement of someone responsible to redo the job and I believe that would be eminently satisfactory to the Village residents. Why can't we sue M&M directly? Because we have no direct legal connection as they contracted with UCO, not the residents.
So why are David Israel's days numbered? Because we will be sending a message to both him and the others in UCO who go along or went along or wish to go along in the future with such carelessness and malfeasance in performing - or not - their duties and responsibilities towards the residents of the Village. If we let this go on, we will have what he desires - a dictatorship wherein he controls all the committees and memberships and even now wants to control the assigning of rooms for clubs and meetings for next year.

I went to this meeting as a resident of the Village, walked into a crowded room filled with upset people and listened to the plaintiffs' lawyer as everyone else did. I believe it is a good suit with plenty of proof and legal facts behind it and a sure way to send a message thru loud and clear. The rest is up to each individual in the Village.
By the way, David Israel has solicited opinions on his blog, which is a joke, as only his people can sign on, so, as usual, objectivity is nowhere to be found. The more things change the more things remain the same. Hohum.
I am the Canadian woman who is new to the Village who took the time to attend your meeting as I am interested in the well being of my new home. You have not quoted me correctly. I stated: we have property that experiences pavement cracking and drainage issues which we have successfully repaired without incurring significant costs and I was suggesting you explore this remedy. The costs the lawyer was quoting: $20,000 retainer; engineering report; forensic accounting analysis; etc. would go along way to remedying the situation.
ReplyDeleteIt is my sense that this is just a politically motivated action by the losers of the election and bears no relevance to the actual facts of the transaction as evidenced by the posting by Grace.
Your group appears to be doing harm to the harmony of this beautiful village as evidenced by the tone of the election posters; the lack of any positive suggestions or platforms; and the chaos that was evident at the meeting; and the disrespect shown to our democratically elected executive.
By the way, how does simply asking a question become "hostile" and "quite vocal" when we were invited to do so? It was obviously a one sided presentation when any opposition was attacked while those in favour were accorded liberty to speak.
It seems to me that Jean knows not what she speaks. The cost that she says can be applied to road repair are not correct. For instance we have a quote to repair the walk around. There are 17 places that have cracks that may be attributed to tree roots. not counting the myriad cracks that exist for other reasons. Although at first look it is no so obvious, but the point is to just repair these 17 cracks cost Quote is $25,000.BTW this area was done about 2 years ago at a cost of approximately $190,000. So if Jeans thinks we can send the super out with a pale of tar and a trowel to fix this on the cheap, she should think again.
DeleteYour words said nothing about fixing, only that both complexes had the same problem. The methods you are now stating that can be used to fix are exactly what the plaintiffs have been advocating and doing so for quite some time.And by the way, this is not "my" group. I had no group there as I was simply a resident sitting and listeneing to a presentation even as I thought about the crumbling roads in my association area and any such suggestion is simply part and parcel of the paranoia of David Israel and his crowd and so sorry that you seemed to have fallen into that crowd.
ReplyDeleteAs far as hostile is concerned, that means unfriendly to the issue being raised, against something and yes, there were some people there, the same crew one always sees like that but by and large the room showed its disappointment and dismay at the paving job, as did the pictures which so clearly showed the miserable quality job it was. Hostile does not mean fights or shouting in a vile way, though I have seen them do that often.
As far as my posters! What was unfriendly about asking people to vote for me or showing my face since I was blocked in the Village, or asking David Israel to debate, which he did not since he obviously is a coward and knew he had no chance, just as he bombed out in the Forum. And respect!!!! When David Israel shows respect for others, for the viewpoints that differ from his, then we can talk respect. I have never dissed him to his face and even shook his hand and wished him luck. That does not show disrespect and by the way, one has to earn respect and he has not earned it but I do believe in civility and so will not yell or scream or curse in public as he does so often. And for Amazing Grace, I have no idea what you are talking about unless it is that ridiculous statement that the delegates are at fault for voting the cheap way. She is out of her cotton pickin' mind as the delegates never had a chance to vote on methodology of paving jobs nor even a chance to vote on transferring money to pay for the crap job. So....please go back to your drawing board and open your mind to the truth. Read your other compatriot's posting. I guess she must live in a different Canada than you do. By the way, if you are new, then take a while and get to know things around here and by the way, welcome to the petty tyrant's dictatorship. Hope you like it.
To Jean the Canadian: Smart people who are new to the village keep their mouth shut and learn first. I guess you are not smart. You say you have property in Canada that is experiences paving, drainage and cracking issues. How much property? Is it you home, Condo? You don't say. Is this property as big as Century Village? If so, you say $20,000 could go a long way in fixing the roads. Give me a break, lady. I want to see you fix the roads in Century Village for a little more than $20,000. You must be suffering from too much sun. Maybe you should go back to Canada to cool off.

You have not learned a thing. You attended this meeting with a closed mind and will remain close-minded until you learn all the facts.
