Have all Greenbrier unit owners been lobotomized?

1) Did all three association delegates inform their unit holders that the 2015 budget as presented would have cost them a minimum of $ 10.00 a month increase for the next 15 years?

2) Did all three association delegates inform their unit holders that the 2015 budget as presented would have made them pay for just finished roadways four times?

3) Did all three association delegates inform their unit holders that the 2015 budget as presented may have exposed them to a federal income tax liability of over $ 250,000.

4) Did all three association delegates inform their unit holders that the 2015 budget as presented would be voted on in two parts for the first time which was never permitted before?

5) Did all three association delegates inform their unit holders that none of them ever attended a meeting, which covered these and other errors in the original 2015 budget?

6) Did all three association delegates inform their unit holders that David Israel lied to over 200 delegates that he allow a forensic team of consisting of two CPA’s your former treasured Dorothy Tetro to perform such audit at no cost to the village?

7) Did all three association delegates inform their unit holders that they were going to vote yes on the original budget, which was defeated, by a wide margin?

If your delegates are guilty of any of all of the above ask them why.

Do not let them do this again at the next vote on the budget.

Hateful little people

So get this. In this day and age there are small hateful people that are watching, looking out their windows to see what trouble they can make.

Olga was accosted by one of these on Saturday. She was posting flyer's for the messenger club meeting on Tuesday Jan 14 at 3:30 Room C clubhouse when one of these little hateful people accosted her. It was the great and renown accoster Phylliss Siegelman. She tried to chase Olga away with her broom (the one she flew in on). She accused Olga of trespassing. Wrong. She accused Olga of soliciting. Also wrong. She threaten and then called the cops. A rover showed. Olga got a recorder and surprisingly Phyllis clammed up.

Is this a free country? Yes. But not to Phyllis. She thinks she has inalienable rights that supersede the rest of us.

I am not surprised.

Volunteerism

Lanny Howe did it again. He hit the volunteer problem right on, but missed the point.

Volunteers should be chosen by their expertise or the availability to do the job. But in this place the volunteers get picked by their politically leanings. If you are against D. Israel on any level then you are out.

There is something wrong in picking Volunteers by political leaning. Such as is picked for volunteer work for the Democrats or for the Republicans.

But No. Israel picks them if they are absolutely for him. He does not brook any deviation from the rule "You are for Israel 110% or you are out.

As is the case of Ed Grossman the only Licensed, register Forensic CPA in Century Village. As is the case of Phyliss, Esther and many others.

So one day Lanny (what kind of name is that?) your time will come and if you do volunteer you will be fired. Or if you like posting on his very private blog he will block you.

Just look at what is happening with the Blogs that represent Century Village. The posters and the commenter's many times sign in anonymously. Why?

What are these posters afraid of? Who are they afraid of? This is a retirement community. It supposed to be peaceful and easy to live in. But apparently it is not. There is something the CV residents are afraid of. This thing, this fear must be gotten rid of. It must be removed. Remember Roosevelt said the "only thing to fear is fear itself." What are we wussies? cowardly wussies? Vote the right way at the DA. No abstains allowed.

The UCO operation is not to be feared. They can not hurt you. The rumors you hear are just that, rumors.

Having said all this. If we are afraid of the relentless anger of our President. then it is simple. Let' remove him. Let's get rid of the fear in our village.

Auditors and auditing

First off let's talk about auditing and auditors. On Friday there was an agreement, an okay from the UCO president to allow ED Grossman, 50 years as a licensed CPA, Dorothy Tetro and George Lowenstein CPA to perform a Forensic Audit. When it was requested that we put this to delegate vote, the President says it was not necessary. And so it wasn't until Monday when he elected to refuse this permission.

So who give this one man all this power to turn down a needed audit. To audit the books he maintains? To allow him to hide any poor or suspect bookkeeping practices that may exist. His excuse was that these were the usual suspects. That is asinine. The usual suspects are UCO and their method of handling our money.

Just exactly what is Israel hiding? The auditors can not manufacture evidence. What is booked is booked.

So he is guarding the money of Century Village and protecting them from any Auditors and a full audit. He is also keeping the CV residents from getting info on UCO bookkeeping  practices. This is like putting the fox in charge of the hen house. We should not allow it.

Yet another case of theft and fraud inflicted on an association by an HOA president made local South Florida headlines recently. According to news reports, Michelle Changar-Coe, a former homeowners association president, has been arrested and stands accused of embezzling more than $180,000 from her Tamarac community.

Police reports indicate that she forged dozens of checks totaling $181,441.85 which were deposited into her bank account. The authorities reported that the fraud and theft occurred at the Mainlands Section 7 homeowners association from January 2009 through December 2013. Changar-Coe, 44, forged the signatures of four persons without their consent between May 2011 and October 2013.

While conducting an audit of financial records, a board member found several checks from community funds that appeared to be forged with his signature and reported it to police. He later found a check for $20,475 that he never recalled signing and had been made payable to a "Michel Chandar," a name that was later found to be bogus.

Every week I am reading articles like this in the newspapers regarding fraud and theft perpetrated by managers of condominium associations. It is prudent for association members to protect themselves and their money against this type of criminal behavior by constant vigilance and a solid understanding of their association's financial dealings with their hard earned cash.

I am not implying that there are any improprieties taking place in our beloved village. I put my trust in the people who are elected to act in our best interests. I trust everyone.

BUT !........ I STILL COUNT MY CHANGE

Audit Questions

AN AUDIT WOULD ANSWER A LOT OF QUESTIONS

There has been much discussion about a UCO FORENSIC AUDIT.  First, the Grand Poohbah says yes, okay, - then reneges and says no, - then yes, then no.  The man is paranoid to be sure.

It would be done by three Villagers, two whom are CPA’s and the third a former UCO treasurer for a number of years.  And, it wouldn’t cost UCO, or anyone in the Village, a single penny.

Just what is the Poohbah afraid of?  Well, he could very well be afraid of 5.3 million dollars that was carelessly and negligently spent.  And now he’s gathering monies to do paving repair work, - like thousands of dollars that he’d like to draw down from a “General Fund” and whisk away the responsibility that he and his backroom button pusher surely have.

So, just what is a FORENSIC AUDIT?  It is an audit whose purpose is to use accounting procedures to collect evidence for the prosecution or investigation of financial crimes such as theft or fraud.  Forensic Audits may be conducted to determine wrongdoing occurred, or to gather materials for the case against an alleged criminal.

To the Grand Poohbah, it would be devastation.  He and his button pusher would need to tell the truth, the whole truth and nothing but the truth.

Perhaps more appropriate would be a FRAUD AUDIT.

1.    A FRAUD AUDIT is a meticulous review of financial documents, while one searches for the point where the numbers and/or financial statements do not mesh, and it is a compliance tool that is used by company management to meet its internal and regulatory obligation to guard against illegal activity.  The standard types of fraud include recording fake transactions, stealing, embezzling, bribery, extortion and kickbacks.

2.    When the doctoring of financial records for purposes of moving funds from certain dedicated categories to other ledger categories without proper identification or authorization, in order to establish an illicit manipulation of funds becomes evident, this action elevates to a FRAUD AUDIT. 

All of the evidence is there, - it just needs to surface.  The auditors take the broad step and actually elevate the characteristics of a transaction to determine if red flags exist that would indicate signs of certain types of fraud that auditors are trained to identify.

Hey, Poohbah, show the people that you’re not afraid, but be sure you get some advice from your button-pusher.

Happy Feet

Happy feet. That is what I must call David Israel because of his propensity to dance the Happy Dance at other people's discomfiture. He was seen outside the Club House doing his Dance of Happiness because of a outcome at a committee meeting that would impact Ed Grossman, or so he thought.

The problem here is that the Little man is Pompous, Arrogant, and Angry. It looks like he will stop at nothing to embarrass or discomfiture the Malcontents. Which have grown from 3 little people to a mob that is beginning to number in the hundreds.

The arrogance of this man and his #1 henchman, Ed Black, is their nerve to complain that the Delegates Voted against his wishes. They voted the 2015 Budget down. Ed Black even has the Arrogance to detail in a posting on the Very Private Blog the details of the 3 committee members that voted NO on HIS budget. 

Now is the time for a recall!

Ed Black ihas finally come out

Well Ed Black has finally come out of hiding and voiced his opinion.

He is talking about the fact the Delegate Assembly turned down his baby, the 2015 Budget. To bad.

The basic problem from where I sit is the lack of communication from the speaker, Howard O'Brien in particular. Asked a question and he would answer "I don't know" or be abrupt in an answer.

But beyond that is the fact that you and your Pal the Great one thinks you can brow beat the committees into submission on your projects. Do you think that threatening the Committee members to get what you and Israel want is the right way to go about getting your Budget entries?

Arrogance, pomposity, threatening and shouting down will not work! Asking for Volunteers for UCO when there are a number of good people that are Banned for Volunteering for Committee work is ludicrous. 

You are chasing away the workers. You are eliminating the bright young, new faces from participating in Committee work for your own private reasons. For your own private, angry reasons. For your own private, angry, and selfish reasons. Unbelievable! 

I think a little more detail in the explanations to the Delegates, especially when it has to do with Budget matters would go a long way with the Assembly.

Also lets remember WiFi is finished, so don't disguise it as some thing else and bring it up to the Assembly again.

Also try to understand the Delegates are not stupid and cannot be led by force. Cannot be dominated by anyone.

The new Budget

The best thing that can happen now that this budget has been thrown out is to have a good old fashioned power point meeting in the clubhouse where more than 20 folks can attend. 

A question and answer period can be very helpful for those of us that need clear answers so we can make good decisions for our village. Copies of the budget should be available to all that attend and a line by line discussion will eliminate any doubts that everything is on the level.

With all due respect I ask the current treasurer to give this deep consideration and hold this meeting way before the next vote to eliminate a repeat of Friday.

The great Disruptor, the great Agitator, The Great Propensity is himself agitated and angry. Things did not go his way and he is keeping score.

He tried his best to get his first try at a budget passed but it failed. Therefore, someone is to blame. But who?  The Malcontents?. Whose ranks have now grown to over a hundred delegates, and of course, these delegates are now a mob. Therefore, call these Delegates Malcontents. I am sure some of these people never heard of the term Malcontent

The problem here is the great one hates to lose. He is a sore loser. That is if you call the Budget vote a competition.

The fact of the matter is there is no conspiracy. There is no collusion. It is just that the delegates are listening, thinking and getting tired of getting all of Israel’s wants jammed down their throats. The result is WiFi is out the Budget will be reworked.

Resident lawyer simulator? Usual suspects? Malcontents?

I have called Israel a pseudo lawyer for his propensity to state lawyerly comments as if he is qualified to be a lawyer. He also is a make believe Civil Engineer and an expert on Roberts rules.

The one rule he constantly breaks is the rule regarding the Chair and getting into arguments with the speakers. This is why I say we would be better off without him to run the Delegate meeting. He is the Great Disruptor.

The Great Disruptor was at it again. At our Delegates Meeting the subject of the new Budget came up. Amid much arguments and yelling the budget was not passed. The great disruptor was in his usual form. Yelling and shouting and threatening the speakers. In particular he was, as I was, happy to see Randy Bochard. But after Randy took the microphone he was seen as disrupting the meeting,  from where I sat the disruption was caused by the Chair it self. He, the chair, thinks he is the know all and end all to the Roberts Rules. He is not.

A lengthy discussion was had on the subject of the Road repairs that are coming up. The 15 year length was questioned. The price of a $1 million per year was questioned. The inspection by a licensed civil engineer was questioned. 

So the  facts are the Treasurer had no information as to how the length and price was arrived at. Dom advised that he had arrived at this cost and time by pretty much guessing. Remember that for every million dollars we try to save the unit holders are assessed $10 per month. So for 2015 we have $700,000 in reserves, so we need $300,000. (That is if they spend the reserves.) The charge is $3 per unit. In 2016 another $1 million has to be put away, another $10 is added to the fees. Per unit fees will increase by $7 for a total increase of $10. And on and on and on...

In the mean time where is the professional Civil Engineer we should be using to advise us? Why do we need one?  So says the Great Disruptor. He figures that he can act as our non-credited lawyer, our in house Civil Engineer and resident expert on Robert's Rules and save us a bundle.

What should have been done was commissioned a Licensed Civil Engineer to advise us on what we should do about the roads, what it will cost, and how long before we have to start.

The excitement at this Delegates Meeting was the question period on the budget. The treasurer was almost non-communicative. So sensible questions concerning the budget was either not answered or were answered abruptly.

So the budget was turned down. The President again broke out his lies and said that if we turned down the 2015 budget we would have to fall back to the 2014 budget and pay again for the WiFi. - WRONG


What will happen is that the 2014 budget will be the current budget. The 2015 budget goes back to be fixed and at the next Delegate Meeting will be voted on again. In the meantime don't pay the $2 per month for the WiFi.

The anger that Israel has for those delegates that go against him became very obvious at this meeting. He broke out the disruptor card again. Although to my way of looking at it he was the disruptor, his constant talking over the delegate and the banging of the gravel is not conducive to good order. He is the one that is out of control and is the disruptor.

What is deemed "surplus funds" in a condo­minium association? If the amount is substan­tial, how is it treated?   How is it shown on the ensuing year's budget for presentation to the mem­bers? Signed, R.L.

Dear R.L.,

Your question has a sig­nificant accounting ele­ment, in addition to the legal element, and while we aren't accountants, we'll take a stab at an an­swer.

 If you were to start with a zero sum in the operating account of an as­sociation, and the associa­tion were to collect funds during the year, and at the end of the year there were funds left over, we would consider those funds to be surplus. 

Or, as explained by the Condo Act, "com­mon surplus" means the amount of all receipts or revenues, including as­sessments, rents or prof­its, collected, by a condo­minium association which exceeds common expens­es." Every owner in a con­dominium owns an undi­vided share of the com­mon surplus. And, wheth­er the amount is significant or not, this surplus would generally either be returned to owners, or applied as a credit to the next year's maintenance. 

There are tax consequenc­es for keeping what would amount to a profit — while condominiums are not for profit, they are not tax ex­empt, and surplus income would generally be tax­able if not returned or ap­plied as a credit.

UCO Fees

There is a lot of question as to what the UCO fees are for 2015. So far the answers you are getting from UCO, specifically David Israel, are either completely wrong or flat out lies.

What you should be paying now, until we get the budget passed, is the same as you paid last year less the $2 for WiFI. We voted down the wifi so that should not be concern any more. If the Budget IS turned down, then the Budget will be revised and voted on at the next delegate meeting.

This budget is not to be approved until the Treasurer, and Israel get right!

Why we have to deal with Israel's WiFI after we voted it down 2 to 1 is a mystery and it should not be allowed to happen.
